This website is operated by Sophie Spencer, sole trader, trading as Branding by Sophie and The Haus of Eva (ABN 64 697 885 572) ("Sophie", "we", "us"). By using sophiespencer.com.au ("the website"), you agree to these Terms & Conditions. If you do not agree, please do not use the website.

2.1 Website content

  • The content on this website is provided free of charge for general information only.

  • It does not constitute legal, financial, psychological, medical or other professional advice. You should seek independent advice that suits your circumstances.

  • Any results, testimonials or case studies reflect individual experiences. Results are not guaranteed.

2.2 Intellectual property

  • All content on this website is owned by or licensed to Sophie. This includes text, photographs, videos, graphics, logos, branding, designs and downloadable resources.

  • You may view and share links to this content for personal, non-commercial purposes.

  • You must not copy, reproduce, republish, sell, resell, rebrand, redistribute or create derivative works from any content without Sophie's prior written permission.

  • You must not scrape the website, or use any of its content (including images) to train, prompt or feed AI tools.

2.3 Free resources and downloads

Any free resource or download is for your personal use only. It must not be shared, reproduced, resold, rebranded or distributed in any form.

2.4 Accessibility and audience

  • This website is open to everyone. Sophie aims to make it accessible for all users.

  • Much of Sophie's content is female-focused, reflecting the women she primarily works with.

  • Sophie's group offerings are women-focused spaces, created for women, people who identify as women, and non-binary people. Branding by Sophie 1:1 sessions are open to all genders.

  • If you have difficulty accessing any part of this website or need information in another format, please email hello@sophiespencer.com.au.

2.5 Bookings and services

  • Bookings and payments are made through third-party platforms, including Flodesk, Stripe, Tally and invoicing tools.

  • Each service has its own terms, which you will accept at the time of booking. Group Headshot Days and Group Photoshoots are covered by the Booking Terms & Conditions provided at checkout. The Haus of Eva Signature Eva Experience is covered by section 2.13 below and a separate signed agreement.

  • Where service-specific terms or a signed agreement conflict with these Terms, the service-specific terms or agreement apply.

2.6 Affiliate links and gifted products

This website and Sophie's social media may occasionally contain affiliate links, sponsored content or products gifted to Sophie. These will always be clearly disclosed. Sophie may earn a commission from affiliate links at no extra cost to you.

2.7 Third-party links

This website may contain links to third-party websites, including podcasts and publications Sophie has been featured in. Sophie is not responsible for the content, accuracy or privacy practices of those websites.

2.8 Social media and community conduct

Sophie's online spaces are intended to be kind and respectful. Sophie may delete comments, restrict or block accounts, or report content that is abusive, discriminatory, harassing, spam or otherwise inappropriate. This is at her discretion and without notice.

2.9 Concerns about content

If you find any content on this website or Sophie's social media offensive, inaccurate or concerning, please email hello@sophiespencer.com.au before raising it publicly. Sophie will do her best to respond within 48 business hours.

2.10 Website and platform availability

Sophie does not guarantee that the website, or the third-party platforms used for bookings, payments and galleries (including Flodesk, Squarespace, Stripe and Pixieset), will always be available or error-free. Sophie is not liable for any loss arising from downtime, technical errors or outages of these platforms.

2.11 Limitation of liability

To the extent permitted by law, Sophie is not liable for any indirect, incidental or consequential loss arising from your use of this website or its content. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.

2.12 Privacy, changes and governing law

  • Your use of this website is also governed by the Privacy Policy at sophiespencer.com.au/privacy-policy.

  • Sophie may update these Terms at any time. The current version will always be published on this page.

  • These Terms are governed by the laws of Victoria, Australia.

2.13 The Haus of Eva — Signature Eva Experience

This section applies to bookings of the Signature Eva Experience, offered by Sophie Spencer trading as The Haus of Eva. Each booking is also covered by a separate written agreement, signed before payment. Where that agreement differs from this section, the signed agreement applies.

The experience

  • A private, 2.5-hour 1:1 boudoir experience held at Hyde Melbourne Place, Melbourne CBD.

  • The experience includes guided meditation, embodiment practices, connection, writing a love letter to yourself, any breaks you need, and the photoshoot.

  • Inclusions:

    • the full edited gallery, supplied as JPGs via a password-protected online gallery;

    • a keepsake box containing a minimum of 10 prints (A6 or larger) and your love letter, wax-sealed;

    • a chai at your handover;

    • hotel room hire.

  • Hair, makeup and styling are not included.

  • Hotel rooms are allocated based on availability. The room's colours, features, furniture and layout may differ from images shown.

Who it is for

  • The Signature Eva Experience is designed for women and non-binary people. Bookings are accepted at Sophie's discretion following a discovery call.

  • Clients must be 18 or older. Sophie may request proof of age.

  • If the experience is purchased as a gift, the person being photographed must complete the enquiry, discovery call and intake form, choose their own session date, and sign the agreement themselves.

How to book

  1. Submit an enquiry through the enquiry form.

  2. Attend a discovery call with Sophie to make sure the experience is the right fit.

  3. Sign the written agreement.

  4. Pay the deposit by invoice to secure your date.

Payment

  • A 50% deposit is due on booking to secure your date. The deposit is non-refundable, as it covers hotel hire.

  • The remaining 50% is due 7 days before your session, unless a payment plan (weekly or monthly) has been agreed in writing.

  • Images and the keepsake box are released only once full payment has been received.

  • A $25 admin fee applies for every 7 days a payment is overdue.

Cancellations, rescheduling and transfers

  • No refunds are given, as hotel hire is non-refundable.

  • Rescheduling is available for emergencies only, including illness supported by a medical certificate. At least 7 days' notice is required where possible.

  • A $200 rescheduling fee applies to cover associated costs. Your new date must be within 6 months of the original date and is subject to availability.

  • Your booking may be transferred to another person only by arrangement with Sophie. The new client must complete a discovery call and sign the agreement.

Your experience and consent

  • The session is private. Only you and Sophie are in the room.

  • A support person is welcome to wait in the hotel's waiting space or bar, and you may step out to see them at any time.

  • Sophie will always ask before any level of nudity and check in with you throughout. There is never any pressure.

  • You may pause or stop the session at any time. Stopping early does not entitle you to a refund.

Editing

Sophie edits colour, light, contrast, texture and grain, and may occasionally remove background distractions. Sophie does not retouch or alter your face, body or skin.

Image privacy and use

  • On your intake form, you choose whether your images may be:

    • shared publicly;

    • shared anonymously, without your face or identifying features; or

    • kept entirely private.

  • You can change your choice at any time by emailing Sophie. Changes apply going forward, and material already published or printed cannot be recalled.

  • Your online gallery is password-protected and available for 30 days, after which it is deleted for your privacy. Please download your images within that time.

  • In line with your chosen privacy option, Sophie may retain selected images. She is not obliged to keep copies of your images after the gallery closes.

Copyright

Sophie retains copyright in all images. You receive a personal, non-exclusive, perpetual licence to use your images for personal purposes. Commercial use, publication, and uploading images to any AI tool are not permitted without Sophie's prior written approval.

Health, safety and conduct

  • You must disclose any medical conditions or accessibility needs on your intake form.

  • You attend at your own risk and are responsible for your belongings.

  • You must follow Hyde Melbourne Place's house rules. You are responsible for any damage you cause to the room or its contents.

Terms for The Haus of Eva events and retreats will be published separately.
